CAISO Regional Transmission Secured Webpage

Summary
FERC Order 890 requires the CAISO to engage in a transparent and collaborative process by giving stakeholders access to confidential information through a secure webpage. Pursuant to this FERC Order, the confidential information shall be made available to those who meet the required criteria. This notice sets forth the procedures for obtaining access to this new webpage.

FERC Order 890 requires the California ISO (CAISO) to engage in a transparent and collaborative process by giving stakeholders access to confidential information through a secure webpage. As part of this collaborative process, sensitive information regarding 2008 activities has been posted to the secure webpage. The secure webpage contains 2009 Local Capacity Requirement (LCR) initial base cases, as well as the Mitigation of Reliance on Old Thermal Generation, including Once-through Cooling units initial base case. As Regional Transmission activities continue, more sensitive information will be available to view.
The criteria for access to the secure webpage are as follows:
1. Entity must be a Market Participant as that term is defined in the CAISO Tariff, or an electric utility regulatory agency within California.
2. Entity must either be a Western Electricity Coordinating Council (WECC) Member or obtain WECC’s acceptance of its Non-Member Confidentiality Agreement, completed, executed and submitted directly to WECC by the Entity. (WECC Non-Member Confidentiality Agreement requires entity to provide a statement of legitimate business need of the confidential information.)
3. Entity must complete, execute and submit to the CAISO, the CAISO Non-Disclosure and Use of Information Agreement for Transmission Planning and Infrastructure Development (NDA). NDA must be originally executed, complete, correct, and the content unchanged (http://caiso.com/1f42/1f42d6e628ce0.html).
a) NDA must include a fully completed and signed Exhibit A for each individual employee of that Entity who is authorized to get access to the TPP information. Exhibit A also includes a mandatory statement that the signing party is or is not engaged in marketing, sales or brokering as set forth in 18 C.F.R. § 358.3(e).
b) NDA must include a fully completed and signed Exhibit B to facilitate the CAISO’s confirmation that the Receiving Party is either a Market Participant or an electric utility regulatory agency within California. Exhibit B must be executed by a person authorized to sign on behalf of the Receiving Party.
